IMMgeo – Terms of use

Terms and Conditions of providing visibility monitoring in AI Search tools by IMM as of 15 June 2026.


Chapter 1. General provisions.

1. Definitions.

IMM – Instytut Monitorowania Mediów S.A. with the registered office in Warsaw at ul. Przyokopowa 33, entered into commercial register of the District Court in Warsaw, XIII Economic – Registry Division under NIP 5272971275,

 KRS 0000922327. 

User – legal entity, physical person or unincorporated organizational unit with capacity to contract obligations and acquire the rights, who activates IMMgeo services.

Contract – a contract for the provision of online services concluded between the User and IMM, of the content corresponding to the Terms and Conditions binding for the User and all individuals who received access to the Service.

IMMgeo Service/Service – a service provided by IMM under the terms and conditions set forth in these Terms and Conditions, which involves examining the position of brands in the responses of search tools based on artificial intelligence. IMM informs that the Service uses AI tools to automatically search, classify, and analyze media content. The User acknowledges that the results provided by the Service may be generated automatically, in whole or in part.

Free Trial Order – determined by IMM at https://immgeo.com#cennik period of time when the Service is provided to the User free of charge.

Subscription Period – a period of the Service provision subject to the Subscription Free.

Subscription Fee – a total monthly fee for the provision of the Service, of the value stipulated in the Commercial Offer.

Commercial Offer – the information on current prices, products and services provided by IMM, available at https://immgeo.com#cennik.

Activation (of the Service)  – rendering available to the User of the functionality and resources of IMM service.

Malfunction – unplanned interruption in the availability of services that occurs due to reasons beyond our control. 

Statute – these Terms and Conditions for the provision of the IMMgeo Service.

2. Terms and Conditions – these Terms and Conditions for the provision of IMMgeo Service.

2.1. These Terms and Conditions stipulate the rules of ordering and performing the Service by IMM, the mode of using the Service by the User and the scope of rights and obligations of the Parties.

2.2 Registering an account on the Website www.immgeo.com or placing an order for a service provided by the Service Provider is tantamount to confirmation that the Service User has read the content of these Regulations and accepts their provisions. 

2.3 The User is obligated to fulfill the obligations arising from these Terms and Conditions throughout the entire period of service provision by IMM. Any conduct by the User that is contrary to their obligations under these Terms and Conditions will constitute non-performance or improper performance of the concluded Agreement. In such a case, IMM will be entitled to exercise the rights specified in these Terms and Conditions and in the Civil Code..

2.4 The Service is ordered via the Service on the website http://www.immgeo.com/ or for existing customers in the IMM database by contacting the IMM Customer Service Department.

Chapter 2. Registration of services, conclusion and terms of the contract, its modification and termination.

1. Registration of services, conclusion and terms of the Contract.

1.1. Unless otherwise stated in these Terms and Conditions, registration for all types of IMMgeo services is performed via the interface located on the IMMgeo.com website or by contacting the IMMgeo Customer Service Department. The date of IMMgeo activation will be considered the date of conclusion of the agreement for the provision of such services between IMMgeo and the User.

1.2. The User is required to enter or provide correct contact information, including that required for issuing a VAT invoice (name, surname, telephone number, email address, company Tax Identification Number, email address for electronic invoice delivery) when activating IMMgeo in the registration form on the website http://www.immgeo.com/ for a free 7-day trial. After the aforementioned period, the User can select the appropriate package for the paid period of provision of the IMMgeo Service during the Subscription Period. Activation of the IMMgeo service for existing customers in the IMM database can be accomplished by contacting the IMM Customer Service Department. For entities conducting business activities, the form should be signed by the person(s) authorized to represent the entity ordering the service in the scope of their commercial activities. Providing false information constitutes a violation of the Terms of Service and entitles IMM to block and discontinue the provision of the Service to the User before the trial period expires, as well as after payment of the subscription fee..

1.3 IMM reserves the right to block or deny access to the Services during the trial period or during the Subscription period if it is demonstrated that:

(i) The User has activated IMMgeo once again after deactivating his account due to the expiry of the trial period referred to above and failure to pay the Subscription Fee, or

(ii) The User has violated the provisions of the Regulations, as a result of which the provision of the IMMgeo service has been discontinued, or

(iii) when the User used the IMMgeo service in a way that exceeded the characteristics of tests and trials or violated the normal use of the Service

(iv) The User uses or has used in the past the IMMgeo service in a manner inconsistent with the selected Commercial Offer,

(v) The user does not use a company email address or does not have authorization to enter into obligations on behalf of the company or has provided false contact details.

1.4 In the event of a User’s payment default and after an unsuccessful payment request, IMM may suspend the Service. Suspending the Service does not constitute a suspension of cooperation between the parties or termination of the Agreement. It also does not constitute a refusal or reduction of remuneration for services provided to the User. Upon presentation of proof of payment of the outstanding amounts, the Service will be resumed. Suspending the Service for the User for the reasons specified in this section does not constitute non-performance or improper performance of the Agreement by IMM.

1.5 If the User is in arrears with payments for two or more invoices, IMM has the right to terminate this agreement without notice, i.e. with immediate effect, while retaining the right of IMM to demand payment of the Subscription Fee until the end of the remaining duration of the fixed-term agreement.

1.6 If the Agreement is for an indefinite period, each party to the Agreement has the right to terminate it by giving one month’s notice, effective at the end of the calendar month.

1.7 The Parties agree that the Subscription Fee will be paid on the day the funds are credited to IMM’s bank account. IMM is not liable for any damages resulting from delays caused by third parties (banks, post offices, couriers, payment intermediaries, domain registrars, etc.).

1.8 Upgrading to a higher package may be done at any time. If IMMgeo extends the scope of services provided, the upgrade will be implemented as follows:

(i) After agreeing on the essential terms of service with IMM (including the price/price change), the User submits an electronic request for a change of services.

(ii) As a confirmation of receipt and acceptance of the request, IMM sends an electronic acceptance of the terms of service to the User, indicating the scope, duration of the services, and the fee.

(iii) Changes to the scope of IMMgeo services take effect on the date of acceptance of the terms by IMM.

1.9 Downgrading to a lower package may only be done by contacting a user’s representative or the IMM Customer Service Department and will be possible starting in the next billing period.

2. Changes in Terms and Conditions.

2.1 IMM reserves the right to amend the provisions of the Terms and Conditions. Amendments to the Terms and Conditions may be required, in particular, to adapt the Terms and Conditions to applicable law or other circumstances.

2.2 The User is bound by the new Terms and Conditions if they consent to their content (through acceptance in the Application/Service/Website, via email, or in another form permitted by IMM, in which the User’s consent will be obtained transparently) or if they fail to terminate the Agreement within 14 days of receiving notice of the amendment to the Terms and Conditions. If the User does not consent to the new Terms and Conditions by submitting a notice of termination, the Agreement will terminate on the day of the last fully paid Subscription Period.

2.3 The current version of the Terms and Conditions will be available at www.immgeo.com.

2.4 In the event of a change to the Terms and Conditions involving a change to the price list posted on the website, payment of the Subscription Fee for the subsequent period in the new amount will be deemed to constitute the User’s consent to the new wording of the Terms and Conditions and will result in the new wording of the Terms and Conditions coming into effect for the given User at the beginning of the period covered by the above payment.

2.5 Changing the website addresses indicated in the Terms and Conditions does not constitute a change to the Terms and Conditions within the meaning of this section and does not require notification of Users of the changes made in the manner specified in point b. above. However, Users will be notified electronically of any change to the website address where the current version of the Terms and Conditions is published or of any change to the addresses of websites referenced therein. Such notification does not require acceptance by Users and does not result in the possibility of termination of the Agreement.

3. Termination of the Contract.


3.1. The Agreement shall terminate upon termination in the cases provided for in the Terms and Conditions or as a result of failure to pay the Subscription Fee (while retaining IMM’s right to demand payment of the Subscription Fee in accordance with Section 2, point d) above.

3.2 IMM reserves the right to terminate the Agreement immediately if the provisions of the Terms and Conditions or applicable law are materially violated, in particular if IMMgeo is used contrary to its intended purpose, including if the User has acted to the detriment of IMM or used IMMgeo for purposes inconsistent with Polish law.

3.3 Termination of the Agreement must be in writing or by means of a document, sent to IMM at imm@imm.com.pl.

Chapter 3. Obligations, rights and responsibility of IMM.

a. IMM undertakes to provide the User with a link to the login page, login, and password for the IMMgeo system.

b. IMM undertakes to immediately repair any interruptions or failures occurring on the IMMgeo system.

c. IMM is not liable for failures or damages resulting from force majeure or other circumstances beyond IMM’s control, nor for damages resulting from a lack of service continuity beyond the control of IMM, improper use of the services, the User’s failure to comply with the terms of the “Terms of Service” and the “Order Form,” or the actions of third parties, companies, or individuals (e.g., connection or hardware failures).

d. IMM guarantees access to the service 24/7, 24/7, with a probability of access of no less than 98% (2% – technical downtime for system maintenance).

e. IMM may update and expand the functionality of the Service at any time on the server. In certain cases, the User will receive updates automatically. g. IMM guarantees that each result or report generated with significant AI support is marked with an appropriate message (e.g., an icon or the annotation “Automatically generated”) in the Service interface, enabling the User to distinguish it from content verified by an analyst.

f. IMM exercises due diligence to ensure that AI tools operate with the highest possible accuracy, but does not guarantee the accuracy of the results. In particular, sentiment analysis and content categorization may be subject to errors resulting from the technological limitations of the current state of knowledge.

g. IMM is not liable for damages resulting from decisions made by the User solely on the basis of automatically generated results, without its own verification—in particular, for incorrect sentiment classification or omitted mentions. j. If an incorrect AI result has led to documented damage to the User, the maximum liability of IMM is limited to the amount of the remuneration paid by the User for the period in which the error occurred, but not more than three months – unless the damage resulted from intentional action or gross negligence of IMM.

Chapter 4. Obligations, rights and responsibility of the User.

a. The User is obligated to ensure that the individuals who will operate the Service are appropriately trained by IMM.

b. The User is obligated to pay the Subscription Fee within 14 days at the latest by bank transfer to IMM’s bank account or by choosing a payment method available within the Service. At the User’s request, IMM allows for an extension of the Subscription Fee payment deadline.

c. The IMMgeo Subscription Fee is solely a fee for using the Service, payable to IMM. It does not include the User’s costs related to obtaining access to IMMgeo, telecommunications fees, or the purchase of hardware or software for using IMMgeo.

d. When quoting or publishing the results of Statistics and Charts from the IMMgeo Service, the User is obligated to always provide the source of the data in the following format: “Source: IMMgeo.”

e. Results and content generated by AI are for informational purposes only and do not constitute advice, business opinions, or any other type of expertise. Users use them at their own risk and are responsible for verifying their accuracy before making any business decisions.

f. Users have the right to submit a complaint to IMM regarding an erroneous AI result; IMM undertakes to review the complaint within 14 days and, if technically possible, to correct or re-analyze it with human assistance.

Chapter 5. Final provisions.

a. Both IMM and the User will be authorized to collect, use, and transmit data only in a manner previously agreed upon by the Parties.

b. These Terms and Conditions come into effect on the date of their publication on the IMMgeo.com website and will apply to Agreements concluded with IMM from that date.

c. Neither Party may disclose the commercial terms of the “Service Agreement” or negotiations relating to this agreement to third parties without written consent. The Parties agree that all information regarding the terms and conditions of IMM’s provision of services to the User and Agency User, including in particular the financial terms, is confidential and, as such, will be subject to appropriate protection by the Parties.

d. In matters not regulated by these Terms and Conditions and the Agreement, the provisions of the Civil Code shall apply. Any disputes shall be resolved by a common court having jurisdiction over IMM’s registered office.
